This document sets out the Terms and Conditions you need to be aware of when using this website. Please take a moment to read them, as they set out your important rights and obligations and I care about making sure we both know where we stand.

When you visit this website, use my services or purchase my products you agree that you are over the age of 18 and willing to be bound by these Terms and Conditions. If you don’t accept this agreement, you should not continue to visit this website or purchase from me.

There are a number of ways you may choose to work with me that are available to purchase or book through my website. The terms and conditions in this document apply to all of my services and products unless alternative terms are explicitly stated.

I offer:

Ebooks – Recipes and meal plans containing recipes containing ingredients whose general nutrient content support the described health goal. Ebooks do not include any direct or email contact with myself or anyone representing Stepping Stones Nutrition.
Consultations – can be telehealth or in person
Metabolic Balance program – a personalised nutrition program based on your blood values, health history, medications and personal preferences.
Courses – online courses providing training relating to the specified product. Courses do not include any direct or email contact with myself or anyone representing Stepping Stones Nutrition.

My intention is to provide tools to make meal planning easier and to inspire people to eat healthier. For individual consultations, I provide information which relates specifically to the symptoms and lifestyle you have informed me of.

If your needs are outside the scope of my services I may refer you to someone from my network of trusted professionals. It is up to you whether you chose to proceed with this recommendation and I am not responsible for anything other than my services.

Some services and products may be exclusive to online services only and I may limit the sales of products or services to any person, geographic region or jurisdiction. This may be exercised on a case-by-case basis.

In offering these services it is my responsibility to keep my skills up to date with CPE points, researching current developments, taking all reasonable care and due diligence, committing to best practice.

When seeking personal advice you are responsible for informing me of any information that is relevant, including information about your health, your families health and health history, diet, any medical procedures you have had, any medications you are on, supplementations you are taking, your lifestyle and activities undertaken, training schedule. If you are uncomfortable with any advice given, please inform me and we can review and discuss the recommendation.

It is your responsibility to ensure that any products, services or information available through this website meet your specific requirements.

IMPORTANT INFORMATION

The website and services may support the relationship between you and other healthcare providers, but are not intended to replace it. If you suffer from any health conditions please consult with the relevant health practitioner.

Please note, you may not get the same results as someone else. Your results depend on how closely you follow the instructions and also your individual make-up, individual consultations will enable more personalised results and can lead to the best results, although as everyone is different, it may take a while (and a bit of trial and error) to find the best treatment for you. Not all symptoms can be resolved by nutrition.

Payment Terms

FORMS OF PAYMENT

Square – for online payments

Cash, credit card or bank transfer for in person consultations

SECURITY POLICY

I do not store or keep a record of credit card details.

My website has an SSL Certificate.

Online payments are taken via paypal.

Credit card payments in clinic are taken via Square payment system. For payment plan options Credit card details are stored securely in the Square payment system.

PAYMENT TERMS

For all online purchases, payment in full is required on ordering.

Payments for in-person consultations are due at the time of the consultation.

Payment for invoiced items is due 7 days after the invoice date. A $50 administration fee will be charged on all late payment.

If we have entered into a payment plan then you are required to pay in full according to the agreed schedule, even if you have completed or cancelled your program.

Prices for my products are subject to change at any time, without notice. The price listed at the time of purchase is the sale price, unless a coupon or discount code has been offered. I may modify or discontinue the Service (or any part or content thereof) without notice at anytime.

I shall not be liable to you or any third party for any modification, price change, suspension or discontinuation of the Service or product sale. If this applies to a membership where continued payments are taken on a direct debit basis, deductions will be ceased and you will be notified.

Delivery and Shipping

DELIVERY

Ebooks will be made available for download on receipt of payment.

Telehealth consultations will be conducted via zoom, details will be provided 24 hours prior to your appointment.

In person consultations are held at my clinic in Freshwater, address details are provided in the confirmation booking email.

Confirmation emails will provide you with requests for information (if any) or preparation required prior to the consultation.

SHIPPING

Shipping costs for any supplements purchased will be charged at cost and will be paid by the purchaser. Where a third party supplier is used, the third party’s shipping charges will apply.

Appointment Policies

APPOINTMENTS

If you need to reschedule an appointment, please provide at least 48 hours notice. Failure to do so will result in a cancellation fee being charged. The cancellation fee will be equivalent to the fee for the rescheduled appointment. I understand that last minute emergencies happen or illnesses, if so, please advise of your non-attendance or lateness as soon as possible, to enable me to reschedule if necessary.

Refund Policy & Consumer Guarantees

CHANGE OF MIND

I do not offer a refund for change of mind or unmet expectations, so I encourage you to consider carefully whether this service or product is right for you before you make your purchase.

PROBLEMS

If you feel there is any problem with my services, please let me know within 24 hours. I would rather know that you are unhappy so that I can address your concerns to find a mutually acceptable solution.

If there is an issue with a download please email me, telling me of the issue and I will endeavor to address the problem. If the download is found to be faulty a replacement will be supplied.

If a technical issue occurs during a telehealth consultation, then I will organise another means of communication or reschedule the remainder of the appointment to mutually agreeable time.

Although I take utmost care and due diligence, I cannot guarantee any result from a service or product I provide as this is dependent on many factors including but not limited to genetics, lifestyle, ability to adhere to recommendations, health of an individual, medications. Should you have any concerns with the product/service or complaints please contact me and I will endeavor to rectify the situation.

INVITATION TO DISCUSS PROBLEM

If you feel that there is any problem with my services, please let me know within 24 hours for a download or before the end of the session for consultations. I would rather know that you are unhappy so that I can address your concerns and try to find a mutually acceptable solution.

LIMITATION OF LIABILITY

I take my obligations under Australian Consumer Law seriously and am keen to hear if you have any problems. However, if there is a problem, my liability is strictly limited to:

Replacing the goods or providing the services again, or
if I am unable to do so within a reasonable time, paying the cost of having the relevant goods or services supplied to you again.

CANCEL ONGOING SUPPLY

For any Standard consultation and services you have paid for in advance. If you cancel and the cancellation is:

Made 48 hours or more prior to the commencement of the Services, we will provide you with a full refund; or
Within 24 hours to the commencement of the Services, we may offer a refund or credit under limited circumstances at our sole discretion.
No Refunds will be given for change of mind or unmet expectations for any products or services. Please choose your ebooks and courses carefully as no refunds will be given.

Cancellations of Packages and Programs

I would like everyone to feel like they have made a great choice in working with me. I understand that for some people, undertaking a program with their individual nutrition plan, along with coaching and mentoring is a significant investment, therefore we ask that you take time to consider your choices as refunds may not be possible.

a) For packages and/or programs that include a Metabolic Balance Plan, a refund (excluding administration fees) may be given prior to pathology being undertaken . Once pathology has been undertaken then fees and charges pertaining to the pathology and administration will be charged, and a partial refund may be offered.
b) Once a Metabolic Balance plan has been generated a refund is not permissible. The Metabolic Balance plan is required to be given with a minimum of 5 consultations. For clients who have opted to pay via a payment plan remaining payments will be taken according to the agreed schedule.

Respectful Communication

COMMENTS POLICY

I encourage people to comment on blogs and social media, however any comments which I consider to be rude, offensive, misleading or spammy will be deleted without any notification or correspondence with you.

THIRD PARTY CONTENT

We may provide you with access to or we may use, third-party tools over which we have no control, nor do we monitor: this includes but is not limited to PayPal and Zoom.

I provide you with access to these third-party tools “as is” and “as available” without any warranties, representations or conditions of any kind and without endorsement. I shall have no liability whatsoever, arising from or relating to your use of the optional third-party tools.

Any use of any optional third-party tools offered on this site or accessed through this site is at your own risk and discretion.

Jurisdiction & Dispute Resolution

NEGOTIATION

If you have any concerns, issues or complaint arising out of your use of this website, my products or services, or these terms and conditions, we agree to communicate with the intention of making a genuine effort to seek a win/win solution, trying to resolve the dispute through negotiation and discussion.

MEDIATION

If we are unable to resolve a dispute by negotiation and discussion, you may access the complaints procedure offered by The Australian Traditional Medicine Society (ATMS) here: https://www.atms.com.au/about-us/complaints/

We agree that neither of us will commence legal action until, in the opinion of ATMS, the potential for negotiation and mediation have been exhausted.

NON-DISPARAGEMENT

We both agree that we shall not publicly or privately disparage each other or anyone connected with the other’s business, but rather shall act in good faith to refrain from any conduct or communication which might reasonably be expected to interfere with the business and/or personal interests of each other.

JURISDICTION

This agreement is subject to the governing law of New South Wales. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
